Summary

  • He has solid experience in providing legal advice to multinational companies operating in Brazil, developed over more than two decades, in contexts requiring a high level of integration between business strategy, contract management and dispute resolution.

 

  • He worked for 14 years with the engineering company of the Fiat Group (then Fiatengineering), including five years on secondment, coordinating its establishment in Brazil. During this period, he was directly involved in the drafting, negotiation and management of complex contracts, including EPC turnkey, EPCM and consortium structures for public tender procedures, as well as in the analysis and conduct of claims and disputes arising from contract performance.

 

  • He advised C‑suite executives at corporate groups such as Petronas Lubricants, Fiat Automobiles and Joy Mining, providing continuous legal support on contractual, corporate and contentious matters, including arbitration and mergers and acquisitions, always in close interface with business management.

 

  • Since 2015, he has acted as an independent neutral in arbitrations, mediations and dispute boards, serving on arbitral tribunals administered by Brazilian and international arbitral institutions, in disputes of high technical and institutional complexity, involving, among other contexts, infrastructure, mining, commercial contracts and matters relating to the public administration.

Education

  • Undergraduate and postgraduate studies: LL.B. from the Federal University of Minas Gerais (UFMG) in 1990, where he was appointed through a competitive process as a teaching assistant in the Commercial Law Department for two years. Postgraduate lato sensu specialisation in Administrative Law at the Brazilian Institute of Teaching, Development and Research (IDP).

  • Arbitration : Postgraduate Diploma in International Arbitration (LL.M. level), with merit, from the School of International Arbitration (SIA), Queen Mary University of London, completed in December 2015, with a focus on International Commercial Arbitration and Arbitration in International Construction Contracts.

 

  • Mediation : Trained by the American Arbitration Association; the New York City Bar (approved under Part 146 of the New York State Unified Court System’s ADR Programs); the International Institute for Conflict Prevention & Resolution (CPR); and JAMS International (by invitation).

 

  • Dispute boards : Certified by the Dispute Board Foundation to act in contractual disputes related to the 2016 Olympic and Paralympic Games.

Arbitration

  • Former member of the Brazilian Committee of the International Chamber of Commerce (ICC);

  • Among recent matters of note, he has acted in arbitration involving a public concession administered by the ICC, in arbitration relating to the structured financing of LPG vessels, in three arbitrations concerning the development and incorporation of large‑scale residential and commercial real estate projects, as well as in M&A arbitrations in the mining and automotive sectors, and in disputes involving a public transport concessionaire. In the mining sector, he has also acted in arbitrations related to greenfield projects.

Mediation

  • Member or fellow of the aforementioned institutions, which also engage in mediation.

  • Among recent notable cases, mediated corporate disputes in the healthcare sector; commercial disputes in the retail services industry; and a corporate dispute in a higher education company, with negotiations exceeding 300 million reais

 

Dispute Resolution Boards

  • Member of the Dispute Resolution Board Foundation for 8 years, the Society of Construction Law, and the Brazilian Institute of Construction Law (IBIDiC), and the International Bar Association (IBA) committees on International Construction Projects until May 2019.

  • Served as a reviewer of the DRB regulations for CREA-MG and was one of the professionals invited by ANTT to discuss the adoption of DRB in public contracts.

  • Among recent notable cases, chaired an Adjudication Committee in a resettlement project for a community relocated due to an environmental disaster in Mariana, MG.
